Tenant Services Authority – National Standards

The Tenant Services Authority published its Regulatory Framework on 1st April 2010. This gives details of the National Standards all registered providers of social housing must deliver.

What does this mean for City West?

The TSA continues to regulate on the basis of their regulatory framework and as such, they expect City West to continue to work towards meeting all of these.

Statutory consultation on revisions to the regulatory framework

The recent Localism Act means important changes to the regulatory framework.

From 1 April 2012, the HCA will be the Regulator of Social Housing. A new independent Regulation Committee will have sole responsibility for the regulatory function. This function will be delivered by regulation staff who will transfer from the TSA.

A Statutory Consultation on a revised regulatory framework sets out the proposed changes.

For landlords, tenants, lenders and other stakeholders who have an interest in the social housing sector, this consultation is an opportunity to influence how the regulator’s revised powers are implemented from April 2012.

The consultation was launched on 21 November 2011, and all responses must be received by 10 February 2012.

The revised regulatory framework will operate following the transfer of the regulatory function to the Homes and Communities Agency (HCA).
The key points are:

  • the regulator will have a backstop role for consumer standards and may only consider intervention where it judges that there is serious harm, or a risk of serious harm to tenants.
  • for breaches of regulatory standards that do not give rise to serious detriment, tenants will have to look to others – local tenant panels, councillors and MPs – to intervene if necessary
  • the regulator’s main role will now be on economic regulation of private registered providers
  • the regulator will retain its focus on governance and viability of providers which is trusted by stakeholders and provides assurance to lenders and providers
  • the regulator will have a new role on value for money in private registered providers
